皆さん、法曹養成制度ときいてもピンと来ない方が多いのではないでしょうか？今回は、私たちが法曹養成制度という主題を扱うに至った、その心をご紹介したいと思います。

出発点は、法文化です。では、文化とは何でしょう？ 文化という言葉は、例えば 人間の生活様式の全体であって、特に 精神的活動について使われる、という特徴があります。そうです、文化というのは、その担い手である人々のあり方と深く関わっているもの、その担い手の人々の特徴そのものでさえあるのです。

では、法の担い手とは？公権力のうち立法権を受け持つ国会・議会でしょうか。或いは、その執行を担当する政府・自治体でしょうか。私たちが着目したのは、特に司法の運用に専門的に関わる、法律の実務専門家、即ち法曹です。日本では、法曹と言って通常裁判官・検察官・弁護士の三者を呼び表していますね。（正確には、本番の展示・発表をご覧下さい。）法の効果を最終的に発揮させる役目は、彼らが担っているのです。

その法曹に関わる事柄の中でも、私たちは特に、彼らがどのように輩出されるのか、そのおおもとを見極めることによって、法曹、ひいては法文化の特徴をあぶりだそうとしています。それがつまり、 法曹養成制度です。日本でも最近、いわゆるロースクールや新司法試験が導入されたり、変化の著しい分野ですね。それを念頭に置きつつ、他のアジア各国ではどうなっているのか、その制度の背景にはどのような考え方・事情があるのか、その比較を通じて、皆さんとともに法文化というものを考えてみたいと思います。

Hi everyone, can you actually imagine what Educational System of Legal Professions means? This time, I will introduce the concept why we finally set the topic on Educational System of Legal Professions.

The starting point was Legal Culture. Can you tell what Legal Culture is? Culture is for example the whole of style of human lives and especially mentions psychic activities. Yes, culture is something deeply related to the way how its bearers are, or even their features itself.

Then, who are the bearers of Law? Is it the National Diet or Local Assemblies / Councils, who bears the legislation among the governmental powers? Is it the National / Local Governments, who execute it? What we focus on is the professions in legal practices, which is the Legal Professions. In Japan, we call it "Housou" usually mentioning judges, public prosecutors, and practicing attorneys. (More specifically, please refer to the Presentation and Exhibition during the Wasedasai 2007.) They are bearing the role to finally exert the effects of Law. Among other topics concerning Legal Professions, we especially try to examine the very origin of how they are produced, so that we can figure out the shape of Legal Professions, or the Legal Culture finally. That is the Educational System of Legal Professions. In Japan, it is a field of recent significant changes as you may know: so-called law schools have been established and the new bar examinations have been introduced. With these facts in mind, we would like to approach the Legal Culture and share it with you all, through comparing the situations in other Asian countries and the background thoughts and conditions behind their system.
